Corruption Case in Tapanuli Utara’s Kominfo Department: Prosecutors Read Indictment for Two Defendants

The trial for the alleged corruption case involving the procurement of Internet Service Provider (ISP) services in the Communication and Informatics Department (Kominfo) of Tapanuli Utara Regency has reached the indictment reading stage. In a session held at the Corruption Court of the Medan District Court, prosecutors from the Tapanuli Utara District Attorney’s Office presented their charges against two defendants accused of involvement in the case.
The two defendants in the trial are Ir. Polmudi Sagala, MM, who served as the Head of the Tapanuli Utara Kominfo Department and Budget User (PA) from 2017 to 2022, and Hanson Einstein Siregar, who was the Head of the Program and Finance Subdivision and also the Commitment-Making Official (PPK) from 2019 to 2021.
Details of the Indictment Against the Defendants
In the indictment, the prosecutors charged the two defendants with subsidiary charges, which include:
1. Primary Charge:
Violation of Article 2, Paragraph (1) Jo. Article 18 of Law No. 31 of 1999 on the Eradication of Corruption, as amended and supplemented by Law No. 20 of 2001.
In conjunction with Article 55, Paragraph (1) point 1 of the Indonesian Penal Code (KUHP).
2. Subsidiary Charge:
Violation of Article 3 Jo. Article 18 of Law No. 31 of 1999 on the Eradication of Corruption, as amended and supplemented by Law No. 20 of 2001.
In conjunction with Article 55, Paragraph (1) point 1 of the Indonesian Penal Code (KUHP).
These articles regulate corruption offenses related to the misuse of authority for personal gain, benefiting others, or corporations, resulting in state financial losses.
The Trial Led by Judges and Prosecutors:
The trial was presided over by Dr. Sarma as the Chief Judge. Meanwhile, the prosecution team handling the case consisted of Roi Baringin Tambunan, SH, MH, the Head of the Special Crimes Division at the Tapanuli Utara District Attorney’s Office, along with David, SH, David Tambunan, SH, and R.Y Malondo, SH.
This case has drawn significant public attention due to the alleged corruption involving public funds in the procurement of ISP services for the Tapanuli Utara Kominfo Department.
Upcoming Trial Schedule:
The trial will continue with different agendas for each defendant:
Ir. Polmudi Sagala, MM is scheduled for another session on Wednesday, February 26, 2025, for the reading of his defense plea (Eksepsi).
Hanson Einstein Siregar, ST will face trial again on Wednesday, March 5, 2025, with the agenda of witness examination.
Alleged Irregularities in ISP Procurement:
The case originated from suspected irregularities in the procurement of Internet Service Provider (ISP) services conducted by the Tapanuli Utara Kominfo Department during the 2020 and 2021 fiscal years. Allegations suggest discrepancies in planning, execution, and accountability, leading to financial losses for the state.
Prosecutors argue that each defendant played a crucial role in the procurement process, with Polmudi Sagala as the Budget User and Hanson Einstein Siregar as the Commitment-Making Official, both allegedly committing acts that led to corruption within the project.
With this indictment, the trial is expected to shed light on how the alleged corruption took place and the extent of the defendants’ involvement. If found guilty, both individuals could face severe penalties under Indonesia’s anti-corruption laws.
